Ropes & Gray Attorneys Author Article on Achieving Meaningful Use of EHR Technology

Corporate partner Michael Beauvais recently published “Achieving Meaningful Use of EHR Technology: Overview of the Proposed Rules, Areas of Concern, and Practice Tips for Hospitals” in Connections, the official publication of the American Health Lawyers Association.  

The article discusses the regulations proposed under the Health Information Technology for Economic and Clinical Health Act (HITECH), a component of the American Recovery and Reinvestment Act of 2009, for the “meaningful use” of “certified EHR technology.” These regulations, which were proposed in January 2010 and will soon be finalized with changes, are designed to incentivize individual and institutional providers delivering health care services to Medicare and Medicaid beneficiaries to implement and use interoperable electronic health records (“EHR”) technology in a “meaningful” way. In particular, the article focuses on the special issues and concerns facing hospitals that seek to participate in one of the two available incentive programs.
