Intellectual property litigation counsel James Davis Jr. (Silicon Valley) and associate Matthew Shapiro (New York) secured a victory for client Emerson Electric Company before the Patent Trial and Appeal Board (PTAB), which agreed to review a Sipco LLC patent that covers a system for remotely communicating information, rejecting arguments the patent was ineligible for the America Invents Act’s covered business method review program.
Emerson sought review under the program for challenging financial patents after it was sued for infringement. The PTAB, agreeing the patent was related to a financial product or service, said Emerson had shown that various claims were likely unpatentable.
