Health Care Partner Examines How HIPAA Privacy Rules Impact Value-Based Care

Health care partner Deborah Gersh was quoted in a Dec. 12 article published in Health Care Compliance Association’s Report on Patient Privacy that examines how HIPAA privacy rules impact value-based health care.

The U.S. Department of Health and Human Services is set to revise HIPAA rules. The revisions are designed to better enable a switch from fee-for-service medicine to value-based care, which requires significant sharing of protected health information for purposes of care coordination, outcomes research and quality improvement.

Ms. Gersh says organizations that want to provide services that aren’t direct medical care, but would help improve care outcomes, run into HIPAA-created hurdles. In the absence of new regulations, organizations will continue to implement innovative value-based care programs, she says; they may seek advisory opinions from the HHS Office of Inspector General.
