The attorneys note that health care providers should ensure that their workforce understands when HIPAA privacy rule guidance does not permit the disclosure of protected health information, even if requested by a law enforcement official. In addition, health care providers must comply with the federal Emergency Medical Treatment and Active Labor Act, even when doing so conflicts with state statutes and regulations.
