In The Wall Street Journal, litigation & enforcement partner Chong Park discussed the Federal Trade Commission potential revisions of the Green Guides that provides guidance on environmental marketing claims.
Chong examined the topic in an alert. In the article he notes that a 2021 U.S. Supreme Court decision severely limited the FTC’s ability to seek money damages on behalf of consumers in federal court. This ruling may be why the FTC is considering promulgating rules covering environmental marketing claims and thereby gain the ability to impose civil penalties for each rule violation.
