In an Inside Health Policy article, health care partner Margaux Hall who leads the firm’s drug pricing and price reporting group, discussed new lawsuits that may be filed against the Centers for Medicare and Medicaid as part of the implementation of the Inflation Reduction Act’s drug price negotiation provision.
Margaux said that as CMS carries out the first round of drug price negotiations certain actions could open the agency to legal vulnerabilities if it adopts standards that are inconsistent with the underlying statutes.
