The U.S. Department of Justice is investigating the role generative AI is playing in facilitating violations of anti-kickback statues and the False Claims Act. In an article published by Bloomberg Law, litigation & enforcement partner Samantha Badlam said, “Historically, the focus of enforcement was on the EHR vendors themselves, but as this industry grows and there are more and more sponsored digital health programs by pharmaceuticals and medical device manufacturers, there is room for DOJ’s enforcement to really evolve in this area.”
