In a Managed Healthcare Executive article, health care partner Stephanie Webster discussed the implications of the U.S. Supreme Court overturning or reducing Chevron deference in federal health care regulation based on an anticipated ruling for cases heard this term.
Chevron set a legal precedent for courts to defer to the federal agencies on how to interpret statutes.
Stephanie notes that if Chevron deference is overturned or modified she anticipates there could be additional challenges to federal agency actions that might not otherwise have been brought. “I think on balance it will make it easier to prevail against the government,” said Stephanie.
