In a New York State Bar Association Health Law Journal article, health care partner Christine Moundas and health care associate Gideon Palte examined the consequences of Change Healthcare’s cyberattack by a ransomware group that involved information from thousands of health care providers, insurers and pharmacies.
The authors analyzed the nationwide implications of the Change Healthcare cyberattack including adverse financial effects for providers that are unable to verify insurance eligibility or submit claims for payment; industry calls for government intervention; and a regulatory focus on cybersecurity. The authors note that while no cybersecurity measures can guarantee protection, complying with applicable legal requirements and current standards can mitigate risk of a cyberattack leading to liability from government investigations or lawsuits brought be affected individuals.
