In an article for The Wall Street Journal, litigation & enforcement partner Samantha Barrett Badlam discussed the disciplinary actions taken by Boston Consulting Group (BCG) amid bribery scheme charges by the Justice Department. BCG’s disciplinary actions come amid pressure on companies by the Justice Department to clawback compensation from employees involved in wrongdoing.
Samantha noted that U.S. companies might face lawsuits from affected employees but restrictive labor laws in some countries can make it difficult for companies to impose such disciplinary measures.
“No matter what country you’re in, having specific provisions in employee agreements that allow you to effectuate clawback of compensation and bonuses in the event of misconduct is critical,” said Samantha.
