Yana Grishkan is a senior attorney in the firm’s litigation and enforcement practice group. Yana focuses her practice on criminal and civil enforcement matters, internal investigations, and related civil litigation. Yana has extensive experience representing individuals and corporate clients in matters involving alleged violations of the Foreign Corrupt Practices Act, False Claims Act, Anti-Kickback Statute, federal and state laws on fraud and conspiracy, and state consumer protection statutes. In addition, Yana has an active pro bono practice, including in the areas of immigration law and civil rights.

Experience

Internal and Government Investigations

  • Represented a major pharmaceutical company and a national non-profit organization in connection with a multi-year investigation by the DOJ into patient assistance programs (“PAPs”), achieving favorable resolutions with the government.
  • Conducted 25+ internal and government-facing investigations for a global pharmaceutical and medical device manufacturer into allegations of corruption, kickbacks, anti-competitive conduct, conflicts of interest, HCP speakerships/sponsorships, third-party vendor misconduct, and other issues involving the client’s subsidiaries in the former Soviet bloc (including Russia, Belarus, Kazakhstan, Azerbaijan, Georgia, Armenia, and Uzbekistan).
  • Represented a leading global chemical company co-owned by a private investment firm client in a DOJ and SEC investigation into allegations of corruption related to a government tender in India.
  • Represented a global specialty pharmaceutical company in connection with a civil investigation by a US Attorney’s Office into alleged off-label promotion and safety concerns.
  • Conducted multiple internal investigations for a leading multinational medical device company into alleged FCPA violations in India, Russia, and Kazakhstan.
  • Conducted internal and government-facing investigations for a US-based multinational medical device company into allegations of kickbacks involving a distributor and improper arrangements with a surgeon practice. Also conducted an internal investigation into alleged FCPA violations in Russia.
  • Represented a medical device manufacturer in successfully responding to a civil investigative demand from a US Attorney’s Office relating to alleged Medicare billing fraud.
  • Conducted internal investigations for a leading healthcare company relating to allegations of improprieties in arrangements with third-party vendors (including kickbacks and conflicts of interest) in Russia and Slovenia.
  • Conducted an internal investigation for a global medical device company into allegations of misconduct relating to the sale and promotion of company products, including off-label and pre-approval promotion.
  • Conducted an internal investigation for a leading hospital related to allegations of kickbacks and nepotism involving construction and building project vendors, including supervision of a forensic audit and preparation of comprehensive recommendations to client to strengthen controls.
  • Conducted multiple internal and government-facing investigations for a Japanese multinational pharmaceutical and biopharmaceutical company relating to its operations in Russia, including allegations of corruption, kickbacks, conflicts of interest, and other improprieties involving patient advocacy organizations, HCP sponsorships, charitable donations, inclusion of products on government reimbursement lists, anticompetitive activities relating to government tenders, and hiring practices involving government officials. 
  • Conducted an internal investigation for a multinational shoe manufacturing company into anonymous allegations of improper arrangements with suppliers in Taiwan.
  • Represented a US-based global biopharmaceutical company in connection with inquiries from a U.S. Attorney’s Office and a state insurance regulator regarding the launch and pricing of a revolutionary treatment.
  • Conducted multiple internal investigations for a global animal health company into allegations of bribery, improper hiring practices involving government officials, improper arrangements with distributors, conflicts of interest, quality concerns, channel stuffing, embezzlement, and organized crime in Egypt, Italy, Russia, Belarus, and China.

Compliance Counseling

  • Conducted a compliance review for a major pharmaceutical company into its relationship with a specialty pharmacy chain, identifying issues that could cause legal or reputational harm to the client and recommending programmatic improvements.
  • Conducted an assessment for an oncology-focused biotech company of controls and processes relating to advertising, marketing, and promotional materials.
  • Conducted a global anti-corruption risk assessment for a multinational, publicly traded pharmaceutical company, including a review of almost 40 markets, providing a comprehensive report with detailed observations and remediation considerations globally, as well as for each market reviewed.
  • Conducted anticipatory, market-wide, anti-corruption compliance review of a Russian subsidiary of a leading global pharmaceutical company.
  • Conducted a risk assessment of US speaker programs for a global biopharmaceutical company (including review of policies and procedures, assessment of operational materials such as strategic plans and trainings, extensive employee interviews, and transaction testing) and provided comprehensive recommendations to client to reduce key enforcement and compliance risks.

Individual Representations

  • Represented multiple individuals in investigation by the US Attorney’s Office for the District of Massachusetts and Massachusetts Attorney General concerning potential violations of False Claims Act relating to Medicare billing and patient rights.
  • Represented a parent charged in the “Varsity Blues” college admissions scandal.
  • Represented a former chief executive officer of an American specialty pharmaceutical company in connection with a prosecution in the U.S. District Court for the District of Massachusetts for alleged scheme to bribe practitioners to prescribe company product.
  • Represented an individual in connection with investigation conducted by the US Attorney’s Office for the District of Massachusetts into allegations of money laundering.
  • Represented a U.S.-based non-profit foundation and its billionaire industrialist benefactor in a corruption and extortion case involving the Russian government.

Due Diligence

  • Advised clients across a range of industries (including private equity, asset management, food and beverage) regarding due diligence matters relating to various transactions and investments around the world.

Pro Bono

  • Secured release of a wrongfully convicted criminal defendant after more than three decades of incarceration based on newly discovered evidence, including DNA evidence and developments in the field of forensic bitemark comparison.
  • Represented wrongfully convicted criminal defendant in winning motion for new trial, successfully arguing that testimony presented at 1992 trial regarding microscopic hair comparison exceeded the limits of science.
  • Acted as Special Assistant Attorney General in representing the Commonwealth’s Department of Children and Families during appeal of termination of parental rights.
  • Represented an indigent criminal defendant in federal court through plea negotiations and favorable sentencing.
  • Represented a Russian/Ukrainian national in seeking political asylum in the United States.
  • Assisted in representation of an asylee in litigation against a federal agency for civil rights violations.
  • Participated in numerous asylum and wrongful conviction screening workshops, interviewing potential applicants, reviewing relevant documents, preparing summaries of cases, and making recommendations on next steps.
  • Routinely assisted needy individuals with US citizenship applications.
