In a new article in Law360, litigation and enforcement partners Dan O’Connor and Helen Gugel, counsel Amish Shah and associate Deborah Maldonado examine the U.S. Securities and Exchange Commission’s potential changing approach to securities enforcement and how those shifts could lead to increased enforcement at the state level.
While this enforcement may come from individual state regulators, state securities laws and state attorneys general, there is also the possibility that multistate enforcement groups could be formed, allowing for the sharing of resources and information, as well as the launch of joint investigations.
As the authors note, states “play a crucial role in securities enforcement, and any potential reduction in federal enforcement may well come with increased state enforcement activity in this space,” which “may require more frequent reviews of existing compliance policies and procedures.”
